1. Introduction

Welcome to The Liquidation Warehouse ("Company," "we," "our," "us"). These Terms & Conditions ("Terms") govern your use of our website located at https://liquidationpalletsshop.com (the "Site") and your purchase of liquidation pallets, truckloads, and related products ("Products").

By using our Site and purchasing our Products, you agree to these Terms. If you are using our Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Eligibility

To use our Site and purchase Products, you must be at least 18 years old and capable of forming a binding contract. By placing an order, you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into a contract
• All information you provide is accurate and complete
• You will use Products for lawful purposes only

3. Products & Descriptions

Our Products are liquidation merchandise, including customer returns, overstock, and shelf-pull items. By their nature, liquidation Products are sold "as-is" and "with all faults."

3.1 Manifest Accuracy

We provide manifests that describe the contents of each pallet to the best of our ability. However, manifests are estimates and small variations may occur (±5% for high-volume items).

3.2 Condition of Products

Products may show signs of wear, have damaged packaging, missing accessories, or other imperfections. Manifest notes provide condition information, but we do not guarantee that every item will be fully functional or sellable.

3.3 Product Images

Product images on our Site are for illustrative purposes only. Actual Products may vary in appearance, packaging, and included accessories.

4. Orders & Payment

4.1 Order Process

When you place an order, you submit a request to purchase Products. We will send you a manifest within 24 hours. After you review the manifest and complete payment, we will prepare your order for shipping.

4.2 Pricing

All prices are in US Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors.

4.3 Payment Methods

We accept credit cards (Visa, Mastercard, American Express), PayPal, and bank transfers. Payment must be completed before shipping.

4.4 Order Cancellation

Orders may be canceled before payment is completed. After payment, cancellations may be subject to a 10% restocking fee. Truckload deposits are non-refundable once the truckload is assembled.

5. Shipping & Delivery

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other factors beyond our control.

5.1 Risk of Loss

Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for loss or damage that occurs during shipping, though we will assist with carrier claims.

5.2 International Shipping

You are responsible for all customs duties, taxes, and import fees. We provide documentation for customs clearance but are not responsible for customs delays or denials.

6. Returns & Refunds

All sales are final. We do not accept returns for change of mind, cosmetic condition, or profit expectations. Please review our Return Policy and Refund Policy for complete details.

If there is a manifest discrepancy, you must report it within 48 hours of delivery with appropriate documentation. Valid claims will be resolved through partial refund, store credit, or replacement items at our discretion.

7. Limitation of Liability

To the maximum extent permitted by law, The Liquidation Warehouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of business or sales opportunities
• Loss of data or goodwill
• Costs of substitute products

Our total liability to you for any claim arising from these Terms or your purchase of Products shall not exceed the amount you paid for the specific Product giving rise to the claim.

8. Disclaimer of Warranties

THE LIQUIDATION WAREHOUSE PROVIDES THE SITE AND PRODUCTS "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability
• Implied warranties of fitness for a particular purpose
• Warranties of title and non-infringement
• Warranties that the Site will be uninterrupted or error-free

9. Indemnification

You agree to indemnify, defend, and hold harmless The Liquidation Warehouse, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

14.1 Dispute Resolution

Any dispute arising from these Terms or your purchase of Products shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Houston, Texas, in accordance with the rules of the American Arbitration Association.

14.2 No Class Actions

You agree to resolve any disputes on an individual basis and waive the right to participate in any class action or representative proceeding.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

We will make reasonable efforts to notify you of material changes, but it is your responsibility to review these Terms periodically.

16. Severability
